1. Acceptance
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
2. The Services
Croma provides programmatic access to information drawn from official public sources, returned as structured data through our API, MCP server, and dashboard. We may add, change, or discontinue features over time.
3. Accounts and API keys
You are responsible for maintaining the confidentiality of your credentials and API keys and for all activity under your account. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to:
- Use the Services in violation of any applicable law or third-party rights.
- Use returned data for unlawful discrimination, harassment, or any purpose prohibited by data-protection or consumer-credit law.
- Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Services.
- Resell or redistribute the Services except as expressly permitted in writing.
5. Lawful use of public-record data
The Services return information from official public sources. You are solely responsible for ensuring that your use of that information has a lawful basis and a legitimate purpose, and complies with applicable data-protection, consumer-credit, and habeas-data rules. You act as the data controller for the queries you initiate.
6. Plans, fees, and billing
Paid plans are billed based on usage and the plan you select. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
7. Intellectual property
Croma and its licensors own all rights in the Services, including software, documentation, and branding. The underlying public records are not owned by Croma. We grant you a limited, non-exclusive, non-transferable right to use the Services under these Terms.
8. Availability
We work to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. Service levels, where offered, are described in a separate agreement.
9. Data accuracy and disclaimers
The Services return information as published by official public sources and provide it on an “as is” and “as available” basis. Croma does not warrant that records are complete, accurate, or current, and is not responsible for the content of the underlying sources. To the maximum extent permitted by law, we disclaim all implied warranties.
10. Limitation of liability
To the maximum extent permitted by law, Croma will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim is limited to the amounts you paid for the Services in the twelve months before the claim.
11. Indemnification
You agree to indemnify and hold Croma harmless from claims arising out of your use of the Services or your breach of these Terms, including claims related to your use of returned data.
12. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or use the Services in a way that creates risk or legal exposure. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the Republic of Colombia. Any dispute will be subject to the competent courts of Colombia, without prejudice to mandatory consumer-protection rules.
14. Changes to these Terms
We may update these Terms from time to time. Material changes take effect when we post the updated version and update the date above. Continued use of the Services means you accept the changes.
